Our Attorneys We are a small, two-attorney law firm practicing almost exclusively in the areas of estate planning and asset protection. Since the firm's establishment in 1979, the primary focus of our practice has been living-trusts-centered estate planning& Medicaid planning, both of which fall under the area of law commonly referred to as Elder Law. More specifically, we help our clients to develop personalized estate plans and/or Medicare planning strategies that will help protect their hard-earned assets and provide for an appropriate allocation of these assets upon their death. In these days of remarkable medical advances, people are living longer, so it has become more important than ever to plan for your future and for the possibility that you may, one day, become partially or completely physically or mentally incapacitated. We find the use of living trusts to be particularly effective in estate planning today. In its most basic form, a living trust enables you to select the individual who will act on your behalf should you ever become incapacitated rather than relying on the court to make that selection. Moreover, upon your death, the selected individual will be responsible for the distribution of your assets in accordance with your wishes as set forth in the living trust. Most importantly, he or she will be able to do so without having to go through the probate process, which saves both time and money. Medicaid planning has also become more critical with the statistical increase in life expectancy. The reality is that, when the time comes, you may find that you don't qualify for or cannot afford long term care insurance. So, what do you do if you have to enter a nursing home? Will you have to spend all of your hard-earned assets just to qualify for nursing home benefits? You'll be relived to know that the answer is, "not necessarily". The fact is there are legal and ethical options available, which enable you to protect at least half of your assets (in most cases), even if you are already receiving nursing home care. Of course, it is always wise and usually more effective to complete the planning process before nursing home care is needed. Moreover, most attorneys encourage their clients to have their estate plan reviewed every three years to make sure that major life changes or other events are adequately reflected in the estate plan. However, most attorneys also charge you for this service. We do not.
